EEOC UPDATE

Job Bias Claims Rise 9% in 2007

Discrimination Charges Highest in 5 Years

In a March 5, 20008 press release, the U.S. Equal Employment Opportunity Commission (EEOC) reported that it received a total of 82,792 private sector discrimination charge filings last fiscal year. That number was the highest volume of incoming charges since 2002 and the largest annual increase (9%) since the early 1990s.

The data, available online at www.eeoc.gov/stats/charges.html, also show that the EEOC recovered $54 million in monetary relief in litigation for job bias victims in 2007. Another $290 million was paid by employers to employees through administrative enforcement procedures, such as mediation.

According to the EEOC's FY 2007 data, retaliation claims, up 18% to 26,663, saw the greatest increase. Age and disability claims were up 15% and 14% respectively. Additionally, reports the EEOC, "nearly all major charge categories showed double digit percentage increases from the prior year -- a rare occurrence." According to the EEOC, "the jump in charge filings may be due to a combination of factors, including greater awareness of the law, changing economic conditions, and increased diversity and demographic shifts in the labor force."

Race claims continued to constitute the most common type of discrimination charge; 30,510 such claims were filed with the EEOC in 2007, a 12% increase.
